THE HIGH Court Sub-Registry In Dar Es Salaam Has Accepted A Request By CHADEMA Chairman, Tundu Lissu, To Admit The Written Statement Of The Second Prosecution Witness As Part Of Evidence For His Defense In The Ongoing Treason Case.
The Court Issued Its Ruling Today, Monday, October 13, 2025, Dismissing The Objection Raised By The Prosecution.
The Case Is Being Heard By A Panel Of Three Judges Led By The Resident Judge In Charge Of The Iringa Sub-Registry, Justice Dunstan Ndunguru, Alongside Justices James Karayemaha And Ferdinand Kiwonde. The Prosecution Is Currently Presenting Its Evidence.
On Friday, October 10, 2025, During Cross-Examination Of The Second Prosecution Witness, Lissu Requested The Court To Accept The Witness's Prior Written Statement As An Exhibit For The Defense.
He Argued That The Written Statement Should Be Admitted In Order To Challenge The Witness’s Credibility By Highlighting Contradictions Between The Statement And The Oral Testimony Given Under Oath In Court.
However, The Prosecution Objected To The Request, Arguing That The Defense Had Not Followed The Proper Legal Procedures As Stipulated Under Section 163 Of The Evidence Act (TEA) And In Various Precedents Set By The High Court And The Court Of Appeal.
